Federal Judge Halts Deportation of Immigrant Shot by ICE During Bronx Arrest

A federal judge has issued a temporary block on the deportation of a Dominican national who was shot by U.S. Immigration and Customs Enforcement (ICE) officers during an attempted arrest in the Bronx, temporarily preventing his removal from the country while his legal challenge to detention is ongoing. U.S. District Judge Paul Oetken ruled that the 28-year-old suspect, identified as Oscar Belgal or Bergal, cannot be deported without a court order and cannot be transferred outside the New York or New Jersey districts without prior court approval. The incident occurred when ICE officers attempted to apprehend the suspect, who allegedly refused to comply with lawful orders and accelerated his vehicle towards officers, prompting at least one officer to fire seven rounds, striking him below the left ear. A 5-year-old child was present in the vehicle but unharmed, though ICE stated the suspect was aware of the child’s presence and endangered him by attempting to evade law enforcement. The suspect, who has prior arrests for assault, robbery, drug and weapons possession, and a grand larceny conviction, and is alleged to have ties to the Trinitarios street gang, survived the shooting and received hospital treatment. The NYPD, which was not involved in the shooting, later released bodycam footage showing the aftermath of the encounter.
