The notice, a precursor to a lawsuit, highlights an exchange where Turning Point USA organizers explicitly warned UVU Police Chief Jeffrey Long about students accessing the rooftop of the Sorenson Center, a building adjacent to where Kirk would be speaking and critically, west of the Losee Center, the very location from which the fatal shot was fired. Despite the warning and a request for enhanced security, the filing claims the chief assured TPUSA organizers, “I got you covered.” The family’s attorneys argue that the risk of a rooftop shooter should have been a paramount concern, especially given the prior attempted assassination of then-President Trump by a rooftop assailant. The notice further details a series of alleged failures by UVU, including inadequate risk assessment, lack of a written security plan, insufficient police presence for a crowd of 3,000, and a denied request for additional officers, forcing Kirk to be transported to the hospital in a private vehicle after the shooting. The family asserts that UVU possessed the authority to implement common-sense safety measures, such as creating secure perimeters or utilizing metal detectors, which were not employed, and that real-time monitoring of security footage, which showed the shooter accessing the Losee Center rooftop, could have averted the tragedy.
