Kohberger’s Lawyer Battles Judge’s ‘Worst of the Worst’ Comments in Bid to Disqualify

Bryan Kohberger’s new legal team is launching a fierce challenge to disqualify the judge overseeing his post-conviction proceedings, arguing that Judge Steven Hippler’s scathing remarks, including calling Kohberger the “worst of the worst” and questioning his honesty, create an unacceptable appearance of bias. Attorney Greg Rauch contends that Hippler’s pre-judgment, made during sentencing after Kohberger’s guilty plea, specifically his assertions that Kohberger “slithered” into the victims’ home and that his capacity for truthfulness was questionable, fundamentally compromises the judge’s ability to impartially consider Kohberger’s post-conviction relief efforts. Rauch highlights Hippler’s pointed questioning during the change-of-plea hearing, where the judge mused, “how could anyone ever be assured that what he speaks is the truth?” and suspected any explanation would be “self-serving and aggrandizing untruthful bits,” as evidence of pre-existing bias. The defense argues that this convergence of strong judicial commentary and Hippler’s prior rulings, such as rejecting requests for discovery extensions and characterizing defense arguments as “ultimately empty” and attempts to delay, goes beyond mere criticism and creates an environment where an “informed, reasonable observer could question its impartiality.” Prosecutors, however, maintain that the sentencing remarks were not enough to demonstrate bias and that Hippler is in the best position to adjudicate the case, a stance Kohberger’s team refutes, arguing that a reassignment would simply change the judge, not the evidence or law, ensuring a fairer process.
