Poisoned Colleague Releases Hidden-Camera Footage as Attacker Seeks Felony Dismissal

Rong Yuan, a former employee at Berkeley Engineering and Research, is releasing damning hidden-camera video footage that captured her colleague, David Xu, allegedly poisoning her water with cadmium, a toxic heavy metal, over more than a year. This act of revenge comes as Xu, who previously faced charges of premeditated attempted murder and two felony counts of poisoning, is now petitioning a judge to dismiss his felony conviction. Xu pleaded no contest to a single count of poisoning and received a plea deal that included probation, which a judge later extended to two years, calling the initial offer “extremely generous.” The video, secretly recorded by Yuan after she began experiencing severe symptoms like dry heaving and hair loss, and a near-death experience after drinking from her water bottle, appears to show Xu tampering with her drink on two separate occasions. Yuan, who felt the legal system had failed her after the lenient plea deal, stated that releasing the video is her “last resort” to ensure accountability, especially as California law may require the felony dismissal if probation terms were met, despite the district attorney’s objection. She recounted the chilling moment she felt she was “going to die” and her mother’s suspicion after tasting a sour substance in the water, prompting her to purchase the spy camera. The footage shows Xu reaching for her water bottle and later pouring a substance into it, an act Yuan described as making her “blood frozen” and her experiencing “death so, so close so many times,” vowing, “I cannot let him go.” The evidence was handed over to the Berkeley Police Department shortly after it was recorded.
