A surrogacy agreement has devolved into a bitter legal battle as biological parents Nausheen Gilkar and Omar Ahmed are suing their surrogate, McKenna West, for over $100,000, alleging a breach of contract and “malicious, outrageous conduct” after she refused their request to terminate the pregnancy following a diagnosis of hypoplastic left heart syndrome (HLHS). The couple, who had already paid West $60,000, claims West defied their wishes, despite the agreement reportedly including provisions for termination, and caused them emotional distress. West, who has been working with pro-life advocates and named the baby “Gabriel,” denies wrongdoing and seeks dismissal of the counterclaims, arguing that no contract can justify the termination of a life and that women are not “incubators for hire.” The child, whom the biological parents refer to as “Rumi,” was born on August 12th and has already undergone a critical heart surgery, with his condition remaining severe. This deeply personal dispute has also drawn intervention from state officials, including Texas Attorney General Ken Paxton, who secured an emergency court order to ensure the baby received necessary medical care, underscoring the complex ethical and legal questions surrounding surrogacy, parental rights, and the termination of pregnancies for medical reasons.
