Family of Murdered Mother and Sons Demands Justice at ICC, Cites Bias Against Iran and Hamas

The uncle of Shiri Bibas, who was brutally murdered along with her two young sons, Ariel and Kfir, by Hamas terrorists on October 7th, is taking his fight for justice to the International Criminal Court (ICC), alleging the court has turned a blind eye to these atrocities while pursuing controversial warrants against Israeli leaders. Maurice Shnaider, whose family has suffered through generations of violence culminating in the horrific deaths of his niece and nephews, has filed two cases with the ICC through legal expert Elliot Malin, president of Stratos Council. The first case, filed in September 2025, seeks warrants against Iranian officials for crimes against humanity, war crimes, and genocide committed in Israel and Gaza, identifying the Islamic Republic as the principal behind its proxies. Shnaider’s filings highlight his family’s history of loss, including the Holocaust, and his personal anguish at witnessing his niece and grand-nephews being taken captive on live television before their deaths. The second case, filed in December 2025, requests investigations and warrants for over a dozen Hamas members for war crimes and crimes against humanity against Palestinians in Gaza, including the use of human shields and torture, arguing that Hamas leaders should be held directly accountable for genocide, citing their own words indicating an intent to eliminate Jews. Despite these filings, Shnaider and Malin claim the ICC has remained unresponsive, leading to accusations of selective justice and bias, especially in light of the ICC prosecutor’s previous actions and subsequent dismissal for misconduct. The ICC’s Office of the Prosecutor stated it is actively investigating all crimes within its jurisdiction since June 13, 2014, operating independently and impartially, but has not commented on the specifics of Shnaider’s cases, citing the need to maintain the integrity of its processes and the safety of all involved. This pursuit of justice comes as the United States has imposed sanctions on the ICC, with Senator Marco Rubio declaring that the U.S. is not subject to the court’s jurisdiction.
