However, the lawmakers contend that this ‘fixed-dose combination policy’ would force newer, improved drug formulations—such as those offering more convenient cancer immunotherapies like quick injections over lengthy IV infusions—into Medicare price negotiations almost immediately after FDA approval. This accelerated negotiation timeline, they argue, would drastically reduce the financial incentives for pharmaceutical companies to invest in and develop these crucial therapeutic advancements, ultimately limiting patient access to cutting-edge treatments. The legislators emphasize that the FDA already rigorously evaluates these improved therapies as distinct medicines, requiring separate clinical trials and approvals, and that CMS should recognize them as such within the negotiation program. Furthermore, they point out that CMS actuaries have failed to demonstrate any substantial taxpayer savings from this proposed policy, leading to the strong conclusion that finalizing it would not only harm patient access to life-saving care but also stifle the very medical progress and innovation essential for combating deadly diseases.
